What is an Afidavit?

- Definition: From the Latin affidavit, meaning "I declare under oath". It is a sworn document that serves as testimony before an agency, entity or court, whether public or private. It is synonymous with affidavit.
- Requirement in Puerto Rico: ⚠️ The affidavit must be signed in person before a notary public; electronic signatures are not permitted.
- If you are outside of Puerto Rico, you can usually go to a local notary. However, we recommend that you first check with the entity in Puerto Rico that is requesting the document, in case there are any additional requirements.
What should an Afidávit include?
- The facts stated must be true to the best of the declarant's knowledge. Giving false information constitutes perjury, a crime.
- The notary must verify the identity of the declarant by:
- valid identification (driver's license or passport); or,
- personal knowledge of the notary about the declarant.

- If you need to use the affidavit outside of Puerto Rico and the United States, you must include an Apostille with your order.
