What is an Inheritance?

In Puerto Rico, an inheritance is the set of assets, rights and obligations left by a person at death, which are not automatically transferred. To claim them, the heirs must make a Declaration of Heirs or follow a valid will, following the rules of the Civil Code. The inheritance may include properties, accounts, vehicles and debts, so it is advisable to start the process as soon as possible to avoid delays and additional costs.

Steps to follow

1. Prepare Declaratoria de Herederos, a legal document that establishes who the heirs are when someone dies without a will. If there is a will, the distribution of the inheritance will follow what the will states, as long as it has been drafted in accordance with the laws of Puerto Rico.
2. Submit the Inheritance Estate Form, from the Department of Treasury, if there are assets valued at $15,000 or more.
3. Transfer real estate properties in the Real Estate Registry.
4. Update the title in the Municipal Tax Collection Center (CRIM).
