Description
What is an Afidavit?
- Definition: From the Latin affidavit, meaning "I declare under oath". It is a sworn document that serves as testimony before an agency, entity or court, whether public or private. It is synonymous with affidavit.
- Requirement in Puerto Rico: The affidavit must be signed in person in front of a notary attorney, since electronic signatures are not allowed. If you are outside of PR, you can go to a local notary. However, we recommend you to check with whoever requested the document in PR to make sure they do not have any additional requirements.
What should an Afidávit include?
- The facts stated must be true to the best of the declarant's knowledge. Giving false information constitutes perjury, a crime.
- The notary must verify the identity of the declarant by:
- valid identification (driver's license or passport); or,
- personal knowledge of the notary about the declarant.
