From Latin. affidavit: 'I declare under oath'. An affidavit is a document sworn in person that serves as testimony before an agency, entity or court, whether public or private. The affidavit is synonymous with affidavit. It is important to note that in Puerto Rico the affidavit can only be granted in person in front of a notary attorney. In other words, electronic signatures are not allowed.
The notary is an official duly authorized by law to execute this type of document. The facts related in the affidavit must be true, to the best understanding of the declarant. Otherwise, the declarant would be committing perjury, which means to give a false oath, which would be a crime. For his part, the notary must ascertain that the declarant is who he claims to be by presenting valid identification, such as a driver's license or passport. In the alternative, if the notary knows the declarant personally, this form of identification is also valid.
