What is the Declaration of Heirs?

✅ The Declaratoria de Herederos is a legal document that determines who the heirs are when a person dies without a will.

🛑 If the deceased left a valid will, a Declaration of Heirs is not required.


👉 Steps to Transfer an Inheritance in Puerto Rico

1️⃣ Obtain a Declaration of Heirs, verifying first that there has not been a will.
2️⃣ Submit the Inheritance Estate Form at the Department of Treasury.
3️⃣ Change the owners of real estate properties (apartments, houses, farms, etc.) at the Property Registry.
4️⃣ Notify and update the owners at the Municipal Revenue Collection Center (CRIM).


⚖️ Order of Heirs

1. Descendants (children) and spouse.
2. Ascendants (parents).
3. Siblings and nieces and nephews.
4. Uncles and cousins.
5. Government, in the absence of heirs.


📑 Common Required Documents

  • Death Certificate
    Children's Birth Certificates
    Marriage Certificate (if applicable)
    Divorce Decree or Certificate of Divorce (if applicable)
